normal style=text-indent:21.0pt;mso-char-indent-count:2.0>為加強(qiáng)對(duì)房屋征收評(píng)估工作的技術(shù)指導(dǎo)，規(guī)范我市國(guó)有土地上房屋征收評(píng)估技術(shù)鑒定行為，維護(hù)征收當(dāng)事人的合法權(quán)益,我局制定了《衢州市房屋征收評(píng)估專家委員會(huì)工作規(guī)程》，現(xiàn)予以印發(fā)，請(qǐng)認(rèn)真貫徹實(shí)施。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第一條　為維護(hù)征收當(dāng)事人的合法權(quán)益, 保障房屋征收評(píng)估結(jié)果的客觀、公平、公正, 根據(jù)《國(guó)有土地上房屋征收與補(bǔ)償條例》（國(guó)務(wù)院令第590號(hào)）、《浙江省國(guó)有土地上房屋征收與補(bǔ)償條例》（省人大常委會(huì)公告第14號(hào)）、《國(guó)有土地上房屋征收評(píng)估辦法》（建房〔2011〕77號(hào)）和《      衢州市區(qū)國(guó)有土地上房屋征收與補(bǔ)償辦法》（衢政發(fā)〔2015〕16號(hào)）等有關(guān)規(guī)定，制定本規(guī)程。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第二條　衢州市房屋征收評(píng)估專家委員會(huì)（以下簡(jiǎn)稱專家委員會(huì)） 由衢州市住房和城鄉(xiāng)建設(shè)局（以下簡(jiǎn)稱市住建局）根據(jù)有關(guān)規(guī)定設(shè)立，成員由房地產(chǎn)估價(jià)師及價(jià)格、房地產(chǎn)、法律、會(huì)計(jì)等方面的專家組成。評(píng)估專家委員會(huì)設(shè)主任一名，副主任、委員若干名。評(píng)估專家委員會(huì)主要承擔(dān)以下職責(zé)：

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（一）對(duì)房屋征收評(píng)估活動(dòng)進(jìn)行技術(shù)指導(dǎo)；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（二）對(duì)房屋征收評(píng)估復(fù)核結(jié)果進(jìn)行技術(shù)鑒定；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（三）參與制定有關(guān)房屋征收評(píng)估的技術(shù)性規(guī)范；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（四）參與房屋征收評(píng)估行為及評(píng)估報(bào)告的檢查、考核；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（五）市住建局交辦的其他工作任務(wù)。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>專家委員會(huì)的成員由市住建局根據(jù)實(shí)際需要進(jìn)行調(diào)整。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第三條　專家委員會(huì)下設(shè)秘書處，秘書處設(shè)在衢州市房地產(chǎn)業(yè)協(xié)會(huì)，負(fù)責(zé)專家委員會(huì)的日常工作。具體職責(zé)如下：

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（一）受理申請(qǐng)?jiān)u估機(jī)構(gòu)復(fù)核結(jié)果鑒定的書面材料。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（二）向?qū)＜椅瘑T會(huì)轉(zhuǎn)交申請(qǐng)?jiān)u估復(fù)核結(jié)果鑒定的書面材料。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（三）收取評(píng)估機(jī)構(gòu)復(fù)核結(jié)果鑒定的有關(guān)費(fèi)用。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（四）向申請(qǐng)人轉(zhuǎn)交專家委員會(huì)出具的書面鑒定意見。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（五）保管評(píng)估機(jī)構(gòu)復(fù)核結(jié)果鑒定工作的有關(guān)檔案資料。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（六）做好評(píng)估機(jī)構(gòu)復(fù)核結(jié)果鑒定的服務(wù)工作及專家委員會(huì)業(yè)務(wù)學(xué)習(xí)培訓(xùn)、技術(shù)指導(dǎo)等其他相關(guān)事項(xiàng)。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第四條  被征收人或房屋征收部門對(duì)原房屋征收評(píng)估機(jī)構(gòu)的復(fù)核結(jié)果有異議的，自收到復(fù)核結(jié)果之日起10日內(nèi)，可以向評(píng)估專家委員會(huì)申請(qǐng)鑒定。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第五條　申請(qǐng)?jiān)u估專家委員會(huì)對(duì)評(píng)估機(jī)構(gòu)評(píng)估復(fù)核結(jié)果進(jìn)行鑒定的，按下列程序辦理：

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（一）申請(qǐng)人向?qū)＜椅瘑T會(huì)秘書處提出申請(qǐng)，填寫《衢州市國(guó)有土地上房屋征收評(píng)估機(jī)構(gòu)復(fù)核結(jié)果鑒定申請(qǐng)表》（附件1），提交下列材料：

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>1.評(píng)估機(jī)構(gòu)的評(píng)估報(bào)告；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>2.評(píng)估機(jī)構(gòu)的復(fù)核結(jié)果；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>3.評(píng)估對(duì)象權(quán)屬的有關(guān)資料；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>4.技術(shù)鑒定所需要的其他材料。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（二）專家委員會(huì)秘書處在收到申請(qǐng)材料后經(jīng)審核，材料齊全的，當(dāng)場(chǎng)受理；材料不齊全的，通知申請(qǐng)人補(bǔ)齊。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（三） 專家委員會(huì)自收到申請(qǐng)材料之日起10內(nèi)組織鑒定小組進(jìn)行鑒定，形成《衢州市房屋征收評(píng)估專家委員會(huì)鑒定意見審核表》（附件2），經(jīng)評(píng)估專家委員會(huì)主任或者副主任簽發(fā)后出具《衢州市房屋征收評(píng)估專家委員會(huì)技術(shù)鑒定意見書》（附件3），并連同鑒定檔案交專家委員會(huì)秘書處。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（四） 專家委員會(huì)秘書處通知申請(qǐng)人領(lǐng)取鑒定意見書，結(jié)算鑒定費(fèi)用。                                     

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第六條  專家委員會(huì)組成鑒定小組進(jìn)行技術(shù)鑒定應(yīng)符合下列要求：

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（一）評(píng)估專家委員會(huì)應(yīng)當(dāng)選派成員組成鑒定小組，對(duì)復(fù)核結(jié)果進(jìn)行鑒定；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（二）鑒定小組成員應(yīng)為3人以上單數(shù)，其中房地產(chǎn)估價(jià)師不得少于二分之一；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（三）作出評(píng)估報(bào)告的評(píng)估機(jī)構(gòu)從業(yè)的專家，應(yīng)當(dāng)回避，不得進(jìn)入鑒定小組；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（四）鑒定小組組長(zhǎng)由小組成員協(xié)商確定，協(xié)商不成的，由主任或副主任指定。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第七條　評(píng)估專家委員會(huì)鑒定小組應(yīng)按下列要求對(duì)評(píng)估機(jī)構(gòu)的復(fù)核結(jié)果進(jìn)行鑒定：

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（一）核實(shí)評(píng)估機(jī)構(gòu)、評(píng)估人員資質(zhì)和報(bào)告書的有效性；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（二）根據(jù)需要可以對(duì)被征收房屋進(jìn)行實(shí)地查勘和調(diào)查。如需對(duì)被征收房屋進(jìn)行實(shí)地查勘和調(diào)查，可以聽取評(píng)估人員、鑒定申請(qǐng)人、征收實(shí)施單位的意見，并做好查勘或調(diào)查記錄；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（三）對(duì)評(píng)估程序、評(píng)估依據(jù)、評(píng)估假設(shè)、評(píng)估技術(shù)路線、評(píng)估辦法選用、參數(shù)選取、評(píng)估結(jié)果確定方式等評(píng)估技術(shù)問題進(jìn)行審核；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（四）形成鑒定結(jié)論。鑒定小組在組長(zhǎng)主持下進(jìn)行評(píng)議，按少數(shù)服從多數(shù)的原則形成鑒定意見，不同意見應(yīng)當(dāng)記錄在案。經(jīng)鑒定，評(píng)估報(bào)告不存在技術(shù)問題的，應(yīng)當(dāng)維持評(píng)估報(bào)告；評(píng)估報(bào)告存在技術(shù)問題的，出具評(píng)估報(bào)告的房地產(chǎn)評(píng)估機(jī)構(gòu)應(yīng)當(dāng)改正錯(cuò)誤，重新出具評(píng)估報(bào)告。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>鑒定意見先由鑒定小組成員簽字，再交評(píng)估專家委員會(huì)主任或者副主任簽發(fā)，出具《衢州市房屋征收評(píng)估專家委員會(huì)技術(shù)鑒定意見書》。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>對(duì)重大、疑難的技術(shù)鑒定項(xiàng)目，鑒定小組難以形成確定性結(jié)論的，由評(píng)估專家委員會(huì)主任或者副主任組織專家集體討論，作出鑒定意見。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第八條  專家委員會(huì)出具的技術(shù)鑒定意見書應(yīng)包括下列內(nèi)容：

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（一）鑒定申請(qǐng)人、鑒定對(duì)象、鑒定事由等鑒定基本情況；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（二）鑒定所依據(jù)的有關(guān)法律、法規(guī)、評(píng)估技術(shù)規(guī)范及其他有關(guān)資料等鑒定依據(jù)；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（三）鑒定意見，包括原評(píng)估報(bào)告是否存在技術(shù)問題，應(yīng)維持或應(yīng)改正錯(cuò)誤，重新出具評(píng)估報(bào)告等事項(xiàng)。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第九條  送達(dá)鑒定意見書，結(jié)算鑒定費(fèi)用。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>專家委員會(huì)秘書處向申請(qǐng)人送達(dá)鑒定意見書。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>房屋征收評(píng)估復(fù)核結(jié)果鑒定費(fèi)用由申請(qǐng)人承擔(dān)。鑒定撤銷原評(píng)估結(jié)果，鑒定費(fèi)用由原房地產(chǎn)價(jià)格評(píng)估機(jī)構(gòu)承擔(dān)。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>專家委員會(huì)作出鑒定意見后，應(yīng)將申請(qǐng)資料、鑒定過程中的查勘和調(diào)查資料、討論的會(huì)議記錄、鑒定報(bào)告及其他有關(guān)資料整理歸檔，交專家委員會(huì)秘書處存檔。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第十條  專家委員會(huì)成員與原評(píng)估機(jī)構(gòu)、被征收人有利害關(guān)系，或者是被征收人的，應(yīng)當(dāng)主動(dòng)回避。相關(guān)人員應(yīng)當(dāng)回避而未回避的，鑒定意見無(wú)效。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第十一條　需要重新作出評(píng)估報(bào)告的，原評(píng)估機(jī)構(gòu)可以征求鑒定小組專家的意見。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第十二條  專家委員會(huì)在房屋征收評(píng)估的技術(shù)指導(dǎo)、鑒定和檢查中，發(fā)現(xiàn)評(píng)估機(jī)構(gòu)有違反《國(guó)有土地上房屋征收評(píng)估辦法》、《房地產(chǎn)估價(jià)規(guī)范》等有關(guān)規(guī)定的行為的，應(yīng)當(dāng)及時(shí)書面報(bào)告相關(guān)部門。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第十三條  專家委員會(huì)成員有下列情況之一的，取消評(píng)估專家委員會(huì)成員資格：

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（一）違反房地產(chǎn)估價(jià)及房屋征收評(píng)估等有關(guān)規(guī)定的；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（二）違反職業(yè)道德和執(zhí)業(yè)規(guī)定的；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（三）無(wú)特殊原因全年三次以上不參加評(píng)估專家委員會(huì)活動(dòng)或不履行工作職責(zé)的；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（四）徇私舞弊，出具的鑒定意見嚴(yán)重偏離工作實(shí)際，未能公正履行職責(zé)的；

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>（五）有其他違法違規(guī)情況的。

normal style=text-indent:21.0pt;mso-char-indent-count:2.0>第十四條  鑒定費(fèi)用標(biāo)準(zhǔn)參照省價(jià)格主管部門的規(guī)定執(zhí)行。鑒定費(fèi)用專項(xiàng)用于專家鑒定、技術(shù)指導(dǎo)、會(huì)務(wù)和業(yè)務(wù)培訓(xùn)、考察學(xué)習(xí)、購(gòu)買房屋交易案例信息服務(wù)，以及專家委員會(huì)秘書處人員工資開支等相關(guān)費(fèi)用。
